Rabun County Court Record Requests
Holly E. Henry-Perry is the Clerk of Superior Court. She comes first for Superior, Magistrate, Juvenile, Accountability, and Family Dependency Treatment Court files. Her official clerk site lists 25 Courthouse Square, Suite 105, Clayton, GA 30525, with phone 706-782-3615 and fax 706-782-1391. The office keeps weekday hours of 8:30 a.m. to 5:00 p.m. The county directory separately lists Suite 201 and 706-960-9709. Confirm the suite and number before you drive over.
- Identify the court, case number, and exact document.
- Check PeachCourt for e-filed Superior papers, or use the clerk counter, phone, fax, or mail.
- Route Probate and municipal files to those separate court offices.
- State whether inspection, a plain copy, or a certified copy is needed.
- Confirm access, cost, and delivery with the custodian.
A Mountain Judicial Circuit calendar can confirm a setting, but it is no substitute for the case file itself. The Rabun docket search routes help you pin down the case before requesting any document.
Rabun Court Custodians Compared
One courthouse does not mean one records desk. The Superior Clerk's broad service role makes the system look more unified than it really is. Probate stands on its own. City courts keep municipal matters, and the Sheriff holds law-enforcement material rather than the filed court case.
| Record | Custodian | Starting route |
|---|---|---|
| Superior, Magistrate, Juvenile, specialty court | Superior Clerk | Counter, phone, mail, or provider |
| Probate and assigned traffic | Probate Court | Probate office |
| Municipal citation | Issuing city | City court or clerk |
| Arrest or incident report | Sheriff custodian | Open-records channels |
Kinds of Rabun County Court Records
Each Rabun court keeps its own slice of the workload. Superior files can hold felony criminal matters. They also hold broad civil cases, divorce, title to land, equity, domestic relations, adoptions, and name changes. Magistrate handles civil claims up to $15,000, dispossessory matters, warrants, and limited criminal work. Probate maintains estate, guardianship, and marriage material. It also covers weapons-carry, vital-record, and assigned traffic items. City courts retain local ordinance and municipal traffic cases.
- Docket sheets and case indexes
- Pleadings, motions, notices, and orders
- Criminal and civil case files
- Public family and specialty-court material
- Probate and municipal files held outside the Superior Clerkâs complete file
A docket entry is not the filed instrument, so ask for the exact paper and its certification level. The clerk's official courthouse FAQ spells out what the office provides.

Its adoption guidance illustrates why record type and access status matter.
Rabun Clerk Request Forms
The county publishes no single certified-copy request form. Its county form index lists general forms, and a clerk feedback form asks only for contact details and comments. Neither treats that feedback form as a formal records order, and the form index itself is what the office publishes.

Call the clerk to confirm the accepted request format, cost, certification, and delivery method.
Rabun Court Records: What They Contain
What is in a file depends on the case and its access level. Public Rabun civil calendar material shows caption and file number. It also lists filing date, answer date, discovery date, jury choice, counsel fields, mediation status, expected duration, and deadlines. A criminal master calendar can list county and judge. It adds event date and codes like CRI, CC, GJ, or Prob Rev. The full file may hold papers that never reach a setting list. Codes and calendar lines are pointers, not the documents themselves.
| Case number | File identifier copied from an official paper |
|---|---|
| Pleadings | Petitions, motions, and answers when public |
| Orders | Signed rulings available at the permitted level |
| Docket sheet | Chronological entries recorded by the court |
| Setting data | Date, judge, term, and calendar type |
Rabun Clerk and Sheriff Files
The Superior Clerk holds the court filings, full stop. For arrest and incident material, the Sheriff's records custodian is Captain Cody Sanders, reachable at 706-782-3612, fax 706-782-7754, cody.sanders@rabuncounty.ga.gov, or mail at 56 Boen Creek Road, Tiger, GA 30576. None of those channels yields a court-certified order. The Sheriff administration source gives the office's own contact details.

An incident report and the later court file are distinct records kept by different offices.
Rabun Copy Fees and Certification
A plain copy just reproduces an available paper. A certified copy carries formal clerk certification, so ask the recipient which form it needs. The clerk posts no official Rabun copy price. That covers ordinary copies, certified copies, electronic downloads, and PeachCourt access. Its fee PDF covers filing and recording fees, not court-copy prices. Ask the clerk for copy costs up front.
| Item | Amount |
|---|---|
| Plain court copy | Not confirmed |
| Certified court copy | Not confirmed |
| Electronic document | Verify live terms |
| Record search | Ask the custodian |

Rabun Digital and Counter Copies
PeachCourt is the official provider for Rabun Superior Court. Registration is open to attorneys and non-attorneys alike. The public login, though, does not show the post-login file filters or the per-document price. Finding a paper online is one task. Viewing it is another. Filing a new paper and getting a certified copy are two more, and none of them is the same job. The counter still matters for certification, a file not exposed online, or an access question. For a quick channel, the county hosts a clerk feedback form on its site.

Because it is labeled as feedback, confirm the office's required records process before submitting a formal order.
Rabun Court Record Access Rules
Georgia's Open Records Act supplies the request and inspection framework. It does not sweep away the rest. Court privacy rules, sealing orders, juvenile confidentiality, adoption limits, and protected identifiers still govern case files. Uniform Superior Court Rule 21 permits access restrictions after the required showing. The court order must state scope and duration. Rule 21.6 covers protected identifiers.
Key rules: Public access is broad but not absolute. Adoption records require a court order under the clerk FAQ, and sealed or juvenile material may remain unavailable without authorization.
Aim a narrow request at the right custodian. Use the Georgia Open Records Act guidance when in doubt. PeachCourt access does not override a sealing order. A public calendar does not prove every filing is open. Magistrate rules require parties and counsel to omit most sensitive identifiers from public filings. Note: A known file may be restricted. Ask whether a public index, a redacted copy, or a court-authorized request is available.
Rabun Courthouse Inspection Planning
Show up at the counter with a tight request. Bring the court name, the full case number, the caption, a rough filing date, and the title of each paper you want. Say upfront whether you want to inspect the file or get a copy. Need it certified? Say that before the copy is made. The clerk site and county directory disagree on the suite number and main phone, so a same-day call to confirm is worth the effort.
Device rules matter too. The Mountain Judicial Circuit usually bars cameras, video equipment, and voice recorders unless approved. Weapons are prohibited outright. Phones may have to stay off or silent, and some visits they may not be allowed at all. Want to photograph a public paper? Ask the clerk first and follow current courthouse policy instead of assuming your own device is fine.
For a paper file that does not show in PeachCourt, ask whether it sits at the counter, is stored elsewhere, or needs a retrieval step. The clerk can confirm timing on older records. Staff cannot give legal advice, though. They can still identify the custodian, the public access status, the copy form available, and the current charge.
Rabun Record Request Check
Check the court name on your source document against the office that will actually receive the request. Superior, Magistrate, Juvenile, Accountability, and Family Dependency Treatment Court records all run through the elected Superior Clerk's service structure. That does not put every record in one online search. Probate, municipal, and sheriff records sit apart entirely.
Once the office confirms the file, ask three things. Is the paper public? Does it need redaction? Does certification change the cost or how it is delivered? Keep the response and the receipt with your copy. When the request is about a hearing rather than a filed paper, check the latest Mountain Judicial Circuit calendar, then confirm any later reset with the clerk.
